terms of service
I. GENERAL- By commissioning the “Artist”, referring to Maplegoose, you have agreed, understood, and read her terms and conditions and will abide by them.- The term “Client” refers to any individual requesting the skills of the “Artist” for any creation involving illustration, design, and conception.- The term “Commissions” or "Commission" refers to the service provided by the Artist to the Client.- The Artist retains the rights and ownership on all commissions.- The Artist reserves the right to refuse to take on any commission for any reason.- The Artist reserves the right to cancel a commission if the terms of service are violated with no refund due to the Client.- Clients are not to submit any AI or NFT related content to be the subject or reference for any commission. Under the circumstance that the Artist becomes aware that any commission is related to generative AI, AI content, or NFTs, the Artist reserves the right to cancel any previously accepted commission with no refund due, even if work has already begun.- The Client may not redistribute the Artist’s contact information in any way unless agreed upon by the Artist in advance.
II. PAYMENTS- All prices are in USD.- Full payment takes place up front after the Artist accepts the commission.- Payment is via ko-fi in USD / US Dollars.- Listed prices are base prices that may increase depending on additional details and the complexity of the commission.- Final prices stated by the Artist are non-negotiable.
III. REVISIONS- Revisions for the Artist will be limited per update to the Client.- Update 1 (finished sketch): The Client is permitted 2 revisions to the line art.- Update 2 (colored line art): The Client is permitted 2 revisions to the color only.- No revisions are permitted to the composition or line art beyond Update 1.- Revision opportunities may be revoked if the Client fails to provide or communicate feedback to the Artist in a timely manner after receiving an Update. In this case, the Client’s commission will be completed based on information provided in the initial request.
IV. DEADLINES AND DELIVERY- General turnaround time will be agreed upon prior to payment and will depend on the size of the commission and the payment. Unless negotiated otherwise, the expected turnaround for commissioned artwork is between 1 - 4 weeks. (Larger commissions are expected to have a discussed turn around, depending on the size of the commission.)- The Artist does not take rush orders.- The Artist is not responsible for providing the Client with a physical object, print, merchandise, etc. of the artwork, unless specifically requested by the Client and agreed upon, in which an extra fee may be applied. Shipping would be covered by the Client.- The final commission piece will be sent as a .png file through email or the platform of the Client’s choice in order to receive the full quality image.
V. USAGE / INTELLECTUAL PROPERTY- The Artist reserves the right to use any artwork she produces, including commissions. This means she may use them for her own personal reasons, such as advertising on her social media, building her portfolio, etc. The client must inform the Artist if they wish to keep their commission private or if it is a surprise for someone else, though it is ultimately at the Artist’s discretion to be posted or not.- The piece may be reposted to the Client’s platforms of choice so long as full credit is given to the Artist.- Commissions are for personal use only. The commissioned piece may NOT be used for commercial purposes and cannot be redistributed or reproduced. The Client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, etc.- Commissions are not to be altered or modified without the Artist’s express written permission.- The commissioned piece and any form or part of it may NOT, under any circumstances, be used for NFTs or any service/product/transaction related to NFTs. The Client may not reproduce or alter the image in any way whatsoever, for use in any NFT related purposes. Absolutely no derivatives of the commissioned piece may be made into/minted/sold/associated as NFTs. This also applies to any commissions in the past and future from the Artist to any and all clients.- Clients are not permitted, under any circumstances, to use their commissioned artwork from the Artist for purposes of training artificial intelligence (AI), including but not limited to, technology that is capable of generating works in the same style/genre as the commissioned artwork. Use of commissioned artwork for any advertising or profits associated with artificial intelligence technology to generate artwork is also strictly prohibited.- Removing any Artist watermarks is a violation of these terms.- The Artist retains the right to crop, edit, or alter the image for promotional use.- The Client may print a copy of the commissioned artwork for personal use if provided with written consent by the Artist. It may not be redistributed or sold in any way.
VI. REFUNDS- The Client may receive a full refund if a full sketch has not yet been sent by the Artist.- The Client may receive a refund for half of the commission payment if a full sketch has been sent by the Artist and the Client is not satisfied.- In the event that the Client is unhappy with the final render of a commission, they will not be eligible for a refund; however, the Artist will do her best to complete all commissions to fit the preferences of the Client.- If the Client wishes to cancel the commission before payment, there are no repercussions. The commission will be cancelled and no further action needs to be taken.- The Artist will do her best to complete all commissions undertaken, however she reserves the right to cancel a commission due to unforeseen reasons. Under these circumstances the Client will receive a full refund.
VII. COMMUNICATION- Feel free to ask the Artist for updates at any time, but please practice a reasonable level of patience and understanding.- The Client must provide clear and concise references/descriptions of their character(s) in order to avoid confusion.- Any written text or communication must be in English (the Artist’s preferred language).- The platform for communication must be established in advance so that both the Client and Artist can have a reliable line of communication, whether it be over email, discord, etc.- By providing the Client with a line of communication to the Artist, the Client agrees to act in a professional manner. Inappropriate / aggressive behavior of any kind by the Client will not be tolerated. Should this behavior occur, the Artist may cancel the commission.
VIII. LIMITS OF LIABILITY- The Artist’s total liability for the commission is limited to the total fees paid for the work.- The Artist is not liable for breakdown of communication, including but not limited to, technical or network-related issues.- The Artist shall not, in any event, be liable for inaccuracies in details between digital artwork and any physical objects shipped to the Client. Colors and smaller details can appear differently when viewed on different screens compared to being printed out in physical format.- This site offers links to other sites enabling you to leave this site and go directly to the linked site. The Artist does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a separate third party through any hyperlinked website or service.- The Artist shall not, in any event, be liable for any damage or loss resulting from hacking, tampering, or other unauthorized access or use of the service or user account or the information contained within.
